This license agreement (the “Agreement”) constitutes a legally binding agreement made between you (the “Licensee”) and Épaule Carrée SAS (the “Licensor”), and is effective  concerning your purchase and/or the download of a free product from https://www.ksetselect.com (the “Site”). Unless otherwise defined in this Agreement, terms used in this Agreement have the same meanings as in our Terms of Use, accessible from www.ksetselect.com

Subject to your acceptance of the terms of this Agreement, Épaule Carrée SAS grants you the limited, non-exclusive, non-transferable, worldwide right and license to use video clip(s), photograph(s), image(s), moving image(s), illustration(s) and graphic(s) (collectively, the “Content”) in accordance with the terms and conditions of the Agreement. 

 

You may use the Content in all media, multiple times without paying royalties or additional fees. 

 

The Content is for your own personal or organizational usage only. You may use the Content for your personal Projects and/or professional Projects you undertake for your clients, subject to the terms of the specific License you purchase.

 

The Content may only be downloaded onto computers, mobile devices, storage devices or cloud accounts owned by you personally or by the entity for whom you are entering this Agreement on behalf of.

 

You may not store the Content anywhere that is accessible by third parties who have not purchased a license. Group buys, where multiple parties pool funds to purchase licenses to the Products, are expressly prohibited and void your License.

 

This is a license and not a sale. Épaule Carrée SAS retains full ownership of the Content and all related files.

 

LIMITATION OF USE 

You may not use the Content in any way that allows others to download, extract, or redistribute content as a standalone file (meaning just the content file itself, separate from the project or end use). The Content may not be used, in part or in whole, as a trademark or service mark, nor may you claim any proprietary rights of any sort in the Content, or any part thereof.

 

You may not falsely represent that you are the original creator of an end use that is made up largely of licensed Content. For instance, you cannot create a painting based solely on licensed Content and claim that you are the author.

You may not make available some or all of the Content on a web page, s

oftware program, or other display as a separate or downloadable reusable file, or disassemble, decompile, reverse engineer, translate, or otherwise decode the Contents for any reason whatsoever. This includes the use of the Content to create entirely new forms of media or Content through the use of machine-learning or artificial intelligence models and tools.

 

If you provide Content or Derivative Works to a client as part of your work product, the client may not reuse the Content or Derivative Works for any purposes other than a review of your work product without purchasing a separate license.

 

You may not use the Content in a pornographic, defamatory, or deceptive context, or in a manner that could be considered libelous, obscene,  illegal or other unlawful manner, to promote violence or hatred, or in violation of any applicable regulations or industry codes. You cannot portray any person depicted in the Content in a way that a reasonable person would find offensive, including but not limited to depicting a model in connection with pornography, “adult videos”, adult entertainment venues, escort services, or the like. You cannot portray a model as engaging in immoral or criminal activities.
